General terms and conditions of business
  1. The following terms and conditions apply to all business transactions with CANIS Dogphotography.
    They are deemed to have been agreed if they are not contradicted immediately. Special arrangements that
    deviate from the terms and conditions will only be recognized if a written confirmation
    present.

  2. Photos within the meaning of these terms and conditions are all products made by the photographer, equal in
    which technical form or in which medium they were created or are available. (negatives,
    Positives, paper images, electronic stills in digitized form, videos, files, etc.)

    Copyright:

  3. The photographer owns the copyright to the photos in accordance with the
    copyright law.

  4. The photos taken by the photographer are only for the own use of the photographer
    determined by the client.

  5. If the photographer transfers rights of use to his works, unless expressly stated otherwise
    otherwise agreed - in each case only the simple right of use was transferred. A transmission of
    Rights of use require a special agreement.

  6. The rights of use are only transferred to the photographer after full payment of the fee
    above.

  7. The customer of a picture i.S. from § 60 UrhG has no right to reproduce the photograph and to
    disseminate unless the corresponding rights of use have been transferred. § 60 UrhG
    expressly waived.

  8. When using the photographs, the photographer can, unless otherwise agreed,
    demand to be named as the author of the photograph. A violation of the right to
    Attribution entitles the photographer to compensation.

  9. The negatives or original files remain with the photographer.
    Fees:

  10. For the production of the photographs, a fee is charged as an hourly rate, a daily rate or an agreed rate
    fixed flat rate; Additional costs (travel expenses, expenses, props, laboratory and material costs,
    etc.) are included in an all-inclusive offer, otherwise to be borne by the client.

  11. The costs are to be paid before the shooting by bank transfer or in cash on the day of the shooting.

  12. The fee is to be paid at the latest within two weeks after receipt of the invoice, if none
    another payment period is specified. After a reminder, the client is in default. After
    If default occurs, interest shall be charged on the fee at 10% p.a. A set-off or exercise
    of the right of retention is only undisputed or legally established
    Claims of the client permissible. Dunning fees and costs (also extrajudicial)
    legal intervention are at the expense of the client.

  13. Until the purchase price has been paid in full, the supplied photographs remain the property of the
    photographers.

  14.  If you don't like the end result, you may request up to 1 post-editing as long as it matches the style of the FOot.
    Further requests for changes must be reasonably acquired.
    A complaint about the entire product or an exchange for a voucher is not possible due to the work already performed.

    Liability:

  15. For breach of obligations not directly related to essential
    contractual obligations, the photographer is only liable for himself and his vicarious agents in the event of intent and
    gross negligence. He is also liable for damage resulting from injury to life, limb or
    of health as well as from the breach of essential contractual obligations that he or his
    vicarious agents through culpable breaches of duty. For damage to
    Photographed objects, templates, films, displays, layouts, negatives or data are liable
    Photographer - unless otherwise agreed - only in the case of intent and gross negligence. At
    loss or damage to images, negatives, digital media is limited
    Liability for compensation on the creation of new recordings. Further claims do not apply. Submitted templates
    or items must be secured by the client against damage, loss, theft and fire
    be insured.

  16. The photographs are usually stored on the photographer's hard drives for further orders.
    Nevertheless, the photographer is not obliged to permanently store the photographs and can delete them at any time.

  17. The photographer is only liable for the lightfastness and durability of the photographs within the framework of the
    Warranty services from the manufacturers of the photographic material.

  18. Films, images and templates are sent and returned at the expense and risk of the customer
    of the client. The client can determine how and by whom the return is made.

  19. Color differences can occur in reproductions, repeat orders and enlargements
    compared to the template or the initial images. This is not a defect of the work and a
    Complaints are not justified as a result.
    Rights of Use

  20. The client only acquires the rights to use the images for private use. The
    Reproduction and disclosure to third parties are permitted for private purposes. One
    commercial use and any commercial and/or public non-private reproduction
    not permitted (except for commercial use with written permission).
    Ownership rights are not transferred.

  21. Julia Laatz / CANIS Dogphotography  may also make the images available to third parties, provided that
    this is for self-promotion. In this respect, the client agrees to the publication.
    VI. Customer's duty to cooperate
    The customer is responsible for ensuring that the photographer is given everything necessary to carry out the order
    required information is available in good time (directions, special requests, etc.).

Before each shooting, a corresponding contract is signed between both parties.
